According to the complaint, Daunte Riley is accused of killing 27-year-old Walter Brooks of Oshkosh intentionally and with the use of a dangerous weapon. The charges filed are as follows:
- First-Degree Intentional Homicide
- Class A Felony
- Disorderly Conduct – Use of a Dangerous Weapon

If convicted of the first-degree intentional homicide charge, Riley would be sentenced to life in prison. Should he be found guilty of disorderly conduct, he would be fined up to $1,000 and/or sentenced to prison by up to 90 days, with a possible six-month increase.
The complaint states that officers were sent to the intersection of East Irving Avenue and Grove Street in Oshkosh around 10:58 p.m. on July 5, for a report that a vehicle had hit a tree and a man was bleeding with injuries.
An officer who arrived noticed a black man without a shirt, lying on the ground next to a vehicle, unconscious. Two people were reportedly conducting CPR on the man, later identified as Brooks.
One of the two people said they heard a crash inside their home and immediately ran outside and saw Brooks leave his vehicle under his power, before collapsing to his knees. Brooks was taken to a hospital with stab wounds and pronounced dead around 11:36 p.m.
Two people claimed that Brooks had been home earlier and gotten a call from his cousin, who asked him to pick them up at Menominee Park, as there was a possible fight.
The complaint alleges that Brooks went over to Riley, asking if he had tried to fight his cousin, before Riley punched him and initiated a chase between the two, leading to the alleged stabbing. A 17-year-old who called the police claims Riley threatened him to step out of a vehicle or be killed.

Riley was arrested at his apartment on the morning of July 6. There were claims of firearms being involved in the incident, but after reviewing the scene and video footage, there was no evidence of a firearm being involved, the complaint said.
Court records show that Riley was in court on July 14 for his initial appearance and had his cash bond set at $1,000,000. He is scheduled to return to court on July 21 for further proceedings and on July 24 for a preliminary hearing.
