GREEN BAY, Wis. (WFRV) – A 62-year-old Green Bay man faces numerous charges, including attempted first-degree intentional homicide, after he allegedly strangled his girlfriend on Friday, August 29.
In a criminal complaint acquired by Local 5, Floyd Simmons faces the following six charges:
- Attempted First-Degree Intentional Homicide
- Up to 60 years in prison, if convicted
- Strangulation and Suffocation
- Up to $10,000 in fines and/or six years in prison, if convicted
- Disorderly Conduct
- Up to $1,000 in fines and/or 90 days in prison, if convicted
- Threatening to Cause Bodily Harm to Certain Individuals Involved With a Court or Legal System
- Up to $10,000 in fines and/or six years in prison, if convicted
- Obstructing an Officer
- Up to $10,000 in fines and/or nine months in prison, if convicted
- Possession of Drug Paraphernalia
- Up to $500 in fines and/or 30 days in prison, if convicted
Police investigating after Wisconsin woman arrested for homicide
The criminal complaint alleges that on Friday morning, around 2:19, officers were sent to the Hampton Inn for a report of a woman who was strangled by Simmons during an argument. The woman said she was unable to breathe and had nearly lost consciousness.
According to the complaint, no further physical altercation occurred. The victim stated that she was in an ‘off and on’ relationship with Simmons for about six months, and they had never lived together; however, she stayed at his apartment for one night.
The complaint alleged that they were at Jackson Square Park drinking alcohol when Simmons left for about 30 minutes, as she believed he was on drugs when he returned, as he was sweaty, allegedly asking her to pay him $300 in rent.
The complaint claims that Simmons grabbed her by the neck and strangled her for about 1-2 minutes, before she punched/kicked him to release her.
In the complaint, an officer reports that Simmons was walking around outside what is listed as his apartment complex and detained him due to the allegations of violent crimes. Simmons reportedly told the arresting officer that he had no statement, though he allegedly muttered under his breath ‘I should’ve killed that (expletive), should’ve stomped on her neck.”
During this interaction, Simmons reportedly said, “I really wanna step on her neck and kill her,” while also telling the officer that if he had a gun, he would shoot them, and that he didn’t care about going to jail, where he allegedly said multiple slurs and sexual statements to staff.
Simmons is set to appear in court for an initial hearing at 2 p.m. on September 3 for the remainder of an initial appearance that occurred Tuesday afternoon, where his bond was set at $100,000.
Wisconsin woman arrested for 3rd OWI after driving with children in vehicle
The second initial appearance was set as he reportedly said he didn’t and can’t read the criminal complaint, alleging the public defender’s office closed the door in his face.
